1. The Service

NameOnTop is an AI visibility monitoring service. It submits questions that resemble real customer queries to third-party AI assistants (such as ChatGPT by OpenAI, Claude by Anthropic, Perplexity and, when available, Gemini by Google), records their answers, and analyses those answers to report which brands are mentioned and how: visibility scores, share of voice, sentiment, cited sources and improvement recommendations.

The Service reports on the output of third-party systems. It does not place, buy or guarantee any presence in AI answers, and it does not modify what AI assistants say.

2. Accounts

You sign in with a magic link sent to your email address; keeping that mailbox secure is your responsibility, and anyone with access to it can access your account. You must provide accurate information and keep it up to date.

You are responsible for all activity in your workspaces, including activity by team members you invite. We may suspend accounts that breach these Terms or that we reasonably believe are being used abusively (including circumventing free-scan limits).

3. Plans, billing and cancellation

Paid plans (Start, Pro, Agency) are billed in EUR as a recurring subscription through our payment provider, Stripe. Prices are shown net of VAT; VAT is added at checkout where applicable, based on your country and VAT status. Invoices are issued automatically.

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from the billing page; cancellation takes effect at the end of the current billing period, and you keep access until then. We do not issue refunds for partial billing periods, except where the law requires otherwise.

Each plan includes usage limits (brands, prompts, scan frequency, team members). We may change plan prices or limits with at least 30 days' notice; changes apply from your next billing period. If a payment fails, we will retry and notify you; if payment is not completed within the grace period, your account is downgraded.

4. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of the rights of others;
• attempt to circumvent technical limits, quotas, anti-abuse measures or access controls;
• probe, disrupt or overload the Service, or access it by automated means other than the interfaces we provide;
• resell or provide the Service to third parties as your own, except as expressly allowed by your plan (Agency white-label reports);
• submit content that is illegal, defamatory or that you have no right to submit.

5. Third-party AI content — no accuracy guarantee

The answers, statements, opinions and citations shown in the Service are generated by third-party AI models. We do not control those models and we do not guarantee the accuracy, completeness, fairness or consistency of anything they say — about your brand, your competitors or anyone else. Our role is to measure and report those statements, not to endorse them.

AI answers are probabilistic: they vary between runs, providers and dates. Scores and metrics in the Service are statistical aggregations of sampled answers and may not reflect what any individual user sees at any given moment. The Service is provided for informational purposes and does not constitute legal, financial, marketing or other professional advice; decisions you make based on the reports are your own.

6. Intellectual property

The Service, its software, design and branding remain our property. The data you submit (brand details, prompts) remains yours; you grant us the licence needed to operate the Service on it. Reports generated for your workspace may be used freely within your organisation and, on the Agency plan, shared with your clients including under your own branding.

7. Warranties and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted or error-free, or that third-party AI providers will remain available on unchanged terms.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim, and we are not liable for indirect or consequential damages, loss of profits, revenue, data or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for intent or gross negligence.

8. Suspension and termination

You may stop using the Service and delete your account at any time from the settings page. We may suspend or terminate access for material breach of these Terms, with notice where practicable. Upon termination, the data deletion terms of the Privacy Policy apply.

9. Changes to these Terms

We may update these Terms as the Service evolves. For material changes we will notify you by email or in the app at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

10. Governing law and disputes

These Terms are governed by the laws of Romania. Any dispute that cannot be resolved amicably is subject to the competent courts of Bucharest, Romania. If you are a consumer in the European Union, mandatory consumer protection rules of your country of residence remain unaffected.
